The next liar is someone who tells "white lies." This isn't gross misconduct because the "white lies" are generally not about important firm matters. Unfortunately, there are binding contracts or unionized contracts out there that make it nearly impossible to fire a worker, even if he or she is not producing quality work. This is where having a worker separation form comes in handy. Therefore, keep your documentation and the worker's personnel file for at least this long. These negotiations frequently occur within a few weeks of the dismissal. There are certain guidelines to follow when dimissing a jobholder and failure to do them well could open you up to a suit. These considerations help make the employee termination process less painful for everyone involved. Veteran managers know that you'll eventually have to separate an employee. Set up a time to meet with the jobholder. Second, it provides you with an easy reference that ensures your rehabilitative procedure is fair and removes the emotions from a circumstance that can cause you too be too forgiving or too harsh. While managers may need to know the general program for firing a subordinate, they don't need the details of every type of layoff.
The company can use this documentation if the worker files a suit. So, while it may be difficult to file an employee, particularly if you have formed a relationship with that person, you should consider the business and your other workforce. Stick to the Facts in the termination Notice. When the worker has exhausted his 3 chances, you can fire him for poor performance.
